Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and 47 Signals LLC, a Wyoming limited liability company doing business as Not Interested ("Not Interested," "we," "us," or "our"). They govern your access to and use of the Not Interested mobile application, its extensions, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. By using Not Interested, you represent that you meet these requirements. If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To use the Service you must create an account using Sign in with Apple. You are responsible for:

• Maintaining the security of your Apple Account and your device.
• All activity that occurs under your account.
• Notifying us promptly at support@notinterested.app if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Description of the Service

Not Interested helps you avoid unwanted texts and calls on iPhone. The Service includes:

• A text message filter that checks texts from unknown senders and sorts spam into the Junk folder.
• Call blocking and labelling based on a list of known spam numbers.
• Spam reporting from the Messages and Phone apps.

4. Text Filtering & Device Settings

Text filtering, call blocking and spam reporting must each be turned on by you in iOS Settings. When text filtering is on, iOS sends texts from unknown senders to our servers to be checked, as described in our Privacy Policy. By turning it on, you consent to this processing.

You may turn any of these features off at any time in iOS Settings.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Submit false or misleading spam reports, including reporting numbers you know are not spam.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service's infrastructure, including by transmitting malware, spam, or excessive automated requests.
• Access or attempt to access another user's account or data without authorization.
• Resell, sublicense, or redistribute the Service or any data obtained through it, including the spam number list, without our prior written consent.
• Use automated scripts, bots, or scrapers to access the Service.

6. Intellectual Property

The Service, including its design, code, graphics, logos, and documentation, is owned by Not Interested and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal purposes, subject to these Terms.

7. Your Data

By submitting spam reports, you grant us a license to use the reported numbers and messages to operate and improve the Service, including to block those numbers for other users.

You may delete your account at any time through the Service. If you delete your account, we will handle your data in accordance with our Privacy Policy.

8. Subscriptions & Payments

Some features of the Service require a paid subscription. Subscriptions are purchased through Apple's App Store and billed to your Apple Account. They renew automatically until you cancel.

You can cancel at any time on your iPhone: in Settings, tap your name, then Subscriptions.

9. No Guarantee of Filtering

Not Interested reduces unwanted texts and calls. It cannot catch every one, and it may occasionally filter one you wanted. In particular:

• Some spam texts and calls will get through.
• A legitimate text may be moved to Junk, and a legitimate call may be blocked or labelled as spam.
• iOS only sends texts from unknown senders to a filter, and decides on its own which senders count as known.

You are responsible for checking your Junk folder for texts you expect, such as verification codes or delivery updates. We are not responsible for any missed, delayed, or filtered text or call, or for any consequence of one.

10. Accuracy & Limitations

Text filtering, call blocking, and spam reporting depend on features of iOS that Apple controls. Apple may change, restrict, or remove these features, and iOS may delay or skip a filter check. We do not control these behaviors and cannot guarantee consistent performance across all devices and iOS versions.

We do not guarantee that:

• Every spam text or call will be caught.
• No legitimate text or call will be filtered.
• The spam number list will be complete or current.
• The Service will function without interruption or error.

11. Third-Party Services

The Service relies on third-party providers for authentication, purchases, spam classification, and other functionality (e.g., Apple, RevenueCat, Google). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Not Interested and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunity.
• Missed, delayed, or filtered texts or calls.
• Costs of procuring substitute services.
• Any matter beyond our reasonable control.

In no event shall our total aggregate liability exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).

14. Indemnification

You agree to indemnify, defend, and hold harmless Not Interested and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.
• Any spam report you submit.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination:

• Your license to use the Service immediately ends.
• We may delete your data after a reasonable retention period, as described in our Privacy Policy.
• Sections that by their nature should survive termination will survive, including Sections 6, 7, 9, 12, 13, 14, and 17.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be resolved as follows:

1. Informal Resolution. Before filing any formal proceeding, you agree to contact us at support@notinterested.app and attempt to resolve the dispute informally for at least 30 days.
2. Binding Arbitration. If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Cheyenne, Wyoming, or remotely at your election. Each party will bear its own costs, except as otherwise required by the AAA rules.
3. Class Action Waiver. You and Not Interested agree that disputes will be resolved on an individual basis only. Neither party may participate in a class action, class arbitration, or other representative proceeding.
4. Exceptions. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.

18. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Not Interested regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
• Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
• Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, internet outages, or government actions.
